Mauritius and India proceeded yesterday (June 23) in Port Louis with the exchange of instruments of ratification of the Treaty on Extradition. The ceremony was presided over by Ambassador A. P. Neewoor, Secretary for Foreign Affairs, and Mr. B. Jaishankar, High Commissioner, on behalf of the Governments of Mauritius and India respectively.

The Treaty, which was signed on 21 November 2003 in New Delhi, aims at rendering cooperation between Mauritius and India more effective with regard to the suppression of crime. It provides concrete steps towards combating terrorism through provision for the reciprocal extradition of offenders.

Some of the features of the Treaty are as follows:

  • Any offence which is punishable with imprisonment or deprivation of liberty for a period of at least one year or by a more severe penalty is to be considered as an extraditable offence;
  • A person shall not be extradited if he is a citizen of the requested State or if the offence committed is regarded as a political offence. The Treaty contains a list of offences which will not be considered as offences of a political character; and
  • Procedures for the extradition.

The Extradition Treaty also provides the respective authorities of the two countries with a legal tool to implement the international conventions against drug trafficking, the United Nations Conventions against terrorism and the Conventions on transnational organised crime and on corruption all of which provide for the obligation to extradite or prosecute.

During the ceremony, both Ambassador Neewoor and High Commissioner Jaishankar expressed satisfaction over the ratification of the Treaty and reaffirmed the commitment of their Governments to work closely together towards deepening the excellent relations between the two countries.
